    Get in touch for a free, no-obligation consultation. We'll discuss your proposed works, explain your obligations under the Party Wall etc. Act 1996, answer any questions you may have, and provide a fixed-fee quotation with no hidden costs.

    Instruction

    Once you are happy to proceed, we'll send you our statutory Letter of Appointment, which gives one of our surveyors authority under the Act to handle the process from start to finish, keeping you informed at every stage and making the legal requirements as straightforward as possible.

    Party Wall Notice

    Serving Notice is the first stage of your project. Your Notice will be professionally researched, prepared and served correctly from the outset. Based on your neighbour's response, additional party wall services such as a Schedule of Condition or Party Wall Award may be required.

From this point, the process depends on how your neighbour responds.

If your neighbour consents

If your neighbour consents to the notice, you can usually proceed with your works once the statutory notice period has expired (or immediately where permitted). For additional protection, we can prepare a Schedule of Condition — a detailed written and photographic record of your neighbour's property before work begins. This provides valuable evidence should any damage claims arise during construction.

If your neighbour dissents

If your neighbour dissents or does not respond to the notice and follow-up letter, the Party Wall etc. Act 1996 requires surveyor(s) to resolve the matter. We'll guide you through the process and prepare the appropriate Party Wall Award, which sets out the rights and responsibilities of both parties, explains how the works should be carried out, and includes a Schedule of Condition to protect everyone involved.

We invoice on completion — not up front. You only pay once your Party Wall Award has been completed and issued.

What is the Party Wall Act?

The Party Wall etc. Act 1996 provides a framework for preventing and resolving disputes in relation to party walls, boundary walls and excavations near neighbouring buildings. It sets out the rights and responsibilities of building owners carrying out works and adjoining owners affected by them.

Do I need to use the Party Wall Act?

You must follow the Act if your proposed works involve building on or astride a boundary, work to an existing party wall or party structure, or excavation within 3m (or 6m for deeper works) of a neighbouring property's foundations. If you're unsure whether your project is notifiable, we can advise.

How do I comply with the Party Wall Act?

Compliance means serving the correct statutory notices on your neighbours, allowing the applicable statutory notice periods to run (generally two months for work to an existing party wall or structure, and one month for excavation or certain boundary works), and dealing with the statutory dispute procedure where required, including obtaining a Party Wall Award where necessary. We handle the entire process on your behalf.

When do I need a party wall surveyor?

You need a surveyor if a neighbour dissents to your notice or doesn't respond, or to prepare a Schedule of Condition. A surveyor ensures the process is handled correctly and protects you from future disputes.

How can I keep the costs as low as possible?

Serve notice early, communicate openly with your neighbours and encourage consent. Where surveyors are appointed, an Agreed Surveyor acting for both parties is often more cost-effective than two separate surveyors. We offer fixed-fee quotations with no hidden costs and invoice on completion.
